April 7, 2014 - On February 7, 2014 — one week into the voting period — the Union asked the Regional Director of the National Labor Relations Board to block the pending election. On February 21, the Region granted that request and impounded the ballots that had been submitted by adjunct faculty members. The University immediately filed a Request for Review, asking the Board in D.C. to overturn the Regional Director’s decision and order the ballots counted. On April 4, 2014, the Board in D.C. denied the Request for Review.
Therefore, over the University’s strong objection, the ballots will remain impounded and the Board will continue its investigation into the unfair labor practice charges. Until the charges are ruled on or resolved, the election will not go forward.
The University has provided the NLRB with a position statement on the ULPs that is located on the web site: on the home page from the green box University Urges Vote Count, Denies Union Charges; on the home page in the chronology of Activities and Events dated March 11, 2014 (scroll down to see it), and on the Resource tab, in the NLRB documents page, under Official Filings.
