SPECIAL ELECTION UPDATE – NLRB Denies Inclusivity; University Calls for Vote Count

February 19, 2014 - Today we received notification that the NLRB in Washington D.C. has denied the University's appeal of the decision limiting the eligible voting unit to main campus adjuncts.
We are disappointed that our inclusive approach has been rejected. However, this decision should pave the way for the ballots, which have been cast and returned to the NLRB Regional Office, to be promptly opened and counted.
Unfortunately, SEIU recently filed a motion to have the ballots "impounded" until its unfair labor practice charges have been investigated. We believe this is an unwarranted and unnecessary delaying tactic and we will challenge it. Not only do we believe that the charges lack merit, but delaying a count of the ballots after they have already been cast is not the normal procedure followed by the NLRB. We are preparing a motion to have the ballots counted as quickly as possible. We will update you as we receive additional information.
